CFTC Finalizes Uncleared Swaps Margin Changes for Seeded Funds

The Commodity Futures Trading Commission has approved a final rule amending margin requirements for uncleared swaps at swap dealers and major swap participants that are not covered by prudential regulator margin rules.

The rule changes the treatment of certain collective investment vehicles that receive start-up capital from a sponsor entity, commonly described as seeded funds. Under the amended definition of margin affiliate, eligible seeded funds will not have margin affiliates, or be treated as margin affiliates of another entity, when firms calculate thresholds that trigger initial margin exchange for uncleared swaps.

The CFTC said the change relieves covered swap dealers and major swap participants from posting and collecting initial margin with eligible seeded funds for up to three years after the asset manager starts investing for the fund.

The final rule also removes a restriction that had disqualified securities issued by certain money market and similar pooled investment funds from serving as eligible initial margin collateral if fund assets moved through securities lending, repo, reverse repo, or similar transactions. The agency also adopted specific percentage haircuts for money market and similar funds.
