SEC Extends Review of Cboe KPI Binary Options Proposal

TET

August 26, 2026

Updated: Fresh

The Securities and Exchange Commission designated a longer period to act on Cboe Exchange’s proposal to permit listing and trading of binary options overlying key performance indicators reported by certain stock issuers.

The August 26 SEC notice says Cboe filed SR-CBOE-2026-061 on June 30, and the proposal was published for comment in the Federal Register on July 15. The filing would amend Cboe Options rules to allow “binary KPI options,” a product category tied to reported issuer metrics rather than a conventional equity or index price.

The SEC said the 45th day after publication is August 29 and that it needed more time to consider the proposed rule change and the issues raised by the filing. The Commission designated October 13, 2026, as the new deadline to approve the proposal, disapprove it, or institute proceedings to determine whether it should be disapproved.

Why it matters

Binary options linked to issuer-reported KPIs would be a notable expansion of exchange-listed product design. For options desks, brokers, and active traders, the review affects whether a regulated options exchange can bring a more event-like payoff structure into listed options markets.

What to watch next

Watch the comment file and the SEC’s October 13 action date. The next step will show whether the Commission is ready to approve the product framework or wants a deeper proceeding on investor protection, disclosure, and market-design questions.
